By accessing or using WeatherRuta at weatherruta.com (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. The Service is operated by FallWest Systems LLC ("we," "us," or "our").

2. Description of Service

WeatherRuta is a free web application that displays weather forecasts along driving routes. Users enter an origin and destination, and the Service calculates a driving route and displays weather conditions at key waypoints along the way. The Service also provides a time slider to preview weather at different departure times.

3. Eligibility

You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this age requirement.

4. User Responsibilities

When using the Service, you agree to:

• Use the Service only for lawful purposes.
• Not attempt to disrupt, overload, or interfere with the Service or its underlying infrastructure.
• Not use automated scripts, bots, or scrapers to access the Service without our written permission.
• Not attempt to reverse-engineer, decompile, or extract the source code of the Service.
• Not use the Service in any way that could damage, disable, or impair its functionality.

5. Weather and Route Data Disclaimer

Weather forecasts provided by the Service are based on third-party data sources and are for informational purposes only. Weather conditions can change rapidly and may differ from forecasts. Driving routes are calculated using third-party routing services and may not reflect current road conditions, closures, or construction.

You should always exercise your own judgment when making travel decisions. Do not rely solely on the Service for safety-critical driving decisions.

6. Intellectual Property

The Service, including its design, layout, graphics, logos, and original content, is the property of FallWest Systems LLC and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from the Service without our written permission.

Weather data is provided by Open-Meteo, routing data by OpenStreetMap and OSRM, and map tiles by OpenStreetMap contributors. These data sources are subject to their own licenses and terms.

7. Advertisements

The Service displays advertisements through Google AdSense. By using the Service, you acknowledge that ads may be displayed and that Google may use cookies and other technologies to serve and measure ads. You can manage your ad preferences through the consent banner or by visiting adssettings.google.com.

8. Third-Party Services and Links

The Service relies on third-party services including Open-Meteo, OpenStreetMap, OSRM, Nominatim, Google Firebase, and Google AdSense. We are not responsible for the availability, accuracy, or practices of these third-party services. Your use of these services is subject to their respective terms and privacy policies.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, FALLWEST SYSTEMS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED $50.

11. Indemnification

You agree to indemnify and hold harmless FallWest Systems LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service or your violation of these Terms.

12. Termination

We reserve the right to suspend or terminate access to the Service at any time, for any reason, without notice. These Terms will survive any termination of your access to the Service.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Wisconsin, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the courts located in Wisconsin.

We may update these Terms from time to time. We will notify you of changes by updating the "Last updated" date at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the updated Terms.
